This bill revises parole provisions by introducing a "second look review" process for certain prisoners and expanding parole eligibility for younger offenders. Specifically, the State Board of Parole Commissioners can now grant second look review to prisoners convicted of category A or B felonies who have served at least 10 years in prison, are not sentenced to death, and do not pose a significant public safety risk. The review process allows various parties, including prison officials, prisoners, attorneys, family members, and medical professionals, to submit applications for review. When considering second look review, the Board can evaluate factors such as the prisoner's age, behavior while incarcerated, rehabilitation program participation, victim impact statements, sentencing consistency, release plan, and community support. Additionally, the bill extends parole eligibility to prisoners who committed offenses when they were under 25 years old (previously 18), allowing parole after 15 years for non-fatal offenses and 20 years for offenses resulting in one victim's death. These provisions will apply to offenses committed on or after January 1, 2026, giving the state time to prepare implementation procedures.
