This bill requires the New York State Department of Education to develop a model policy by December 31, 2025, that prohibits students from using cellular telephones during classroom instruction. The policy must be created with input from students, parents, and educators, and will be updated every five years. By July 1, 2026, every school district in the state, including the New York City school district, must adopt a similar policy that either directly uses or modifies the state's model policy. The bill allows for specific exceptions to the cellular telephone ban, such as emergencies, when a teacher grants permission, when a physician determines phone use is necessary for a student's health, or when a student's individualized education program requires phone use. The policy may also include enforcement mechanisms to limit access to cellular telephones during classroom instruction. The act will take effect immediately upon passage.
