This bill amends the New York Vehicle and Traffic Law to create a new category of aggravated unlicensed operation of a motor vehicle in the first degree. Specifically, a person can now be charged with this more serious offense if they are operating a motor vehicle while having their license suspended under certain conditions and they cause the death or serious physical injury of another person. The bill adds a new subparagraph to existing law that elevates the offense from a third-degree aggravated unlicensed operation to a first-degree charge when the unlicensed operation results in a fatality or serious injury. Additionally, the bill makes corresponding technical amendments to the exceptions section of the law to ensure the new provision is properly referenced. The legislation is designed to impose stricter penalties on drivers who continue to operate vehicles illegally and whose actions result in significant harm to others. The bill will take effect on the first of November following its passage into law.
