This bill modifies Texas state law regarding surcharges and remittances for low-level radioactive waste disposal and storage at the Texas Low-Level Radioactive Waste Disposal Compact waste disposal facility. Specifically, the bill reduces the surcharge for disposing of nonparty compact waste from 20% to 15% of the total contracted rate and changes how the surcharge is distributed. Previously, the entire surcharge was deposited into the environmental radiation and perpetual care account, but now two-thirds will go to that account and the remaining one-third will be remitted to the host county. Similarly, for radioactive waste or elemental mercury storage lasting over one year, the bill mandates that 50% of the remittance will go to the general revenue fund, with the other 50% going to the host county. These changes apply only to surcharges collected and remittances made on or after the bill's effective date of September 1, 2025, with previous surcharges and remittances still governed by the prior law.
