Prohibits each school board from employing or contracting for the services of any individual who has been convicted of any felony crime of violence as defined in the bill or any offense involving a child. Current law prohibits each school board from employing or contracting for the services of any individual who has been convicted of any violent felony set forth in a certain statutory definition of "barrier crime" or any offense involving the sexual molestation, physical or sexual abuse, or rape of a child, or the solicitation of any such offense.
AI Summary
This bill modifies existing Virginia law regarding the employment and contracting practices of school boards, specifically addressing the hiring of individuals with certain criminal convictions. The bill expands and clarifies restrictions on hiring individuals with felony convictions, creating a more nuanced approach to employing people with criminal backgrounds. Under the new provisions, school boards are prohibited from hiring individuals convicted of offenses involving child sexual molestation, abuse, or rape. For other violent felonies or crimes of moral turpitude, the bill now allows potential employment or contracting if specific conditions are met: the individual must have had their civil rights restored, been released from supervision for over 20 years, be considered of "upstanding character," and demonstrate commitment to community service and rehabilitation. The school board must also certify in writing that the individual meets these requirements. The bill maintains strict prohibitions against hiring individuals convicted of child-related sexual offenses while providing a more rehabilitative pathway for individuals with other types of felony convictions. Additionally, the bill requires applicants to disclose criminal history and imposes penalties for making false statements, including potential misdemeanor charges and professional license revocation.
