This bill enacts the "Independent Senior Housing Resident Freedom of Choice Act" to expand the rights of residents in independent senior housing, shelters, and residences by clarifying and broadening their ability to obtain personal care and home care services. The bill modifies existing public health law to explicitly allow independent senior housing residents to: (1) personally obtain personal care or home care services from licensed agencies such as home care services agencies, certified home health agencies, and long-term care programs; (2) have licensed agencies offer and provide services to residents in a manner similar to services provided to people living in their own homes; (3) choose and obtain services from appropriately licensed agencies or use technologies that help maintain independence; and (4) receive additional supportive services from housing operators like room and board, laundry, housekeeping, transportation, and emergency assistance. The bill also prohibits independent senior housing operators from limiting residents' service options or inducing residents to use specific service providers for personal financial benefit, thereby ensuring residents maintain their autonomy and freedom of choice in managing their care and support services.
