AI Summary

This bill establishes a comprehensive framework for regulating student support agencies that provide services to public elementary and secondary schools in Virginia, with a primary focus on protecting student personal information and ensuring data security. The bill requires all student support agencies to register with the Department of Education and mandates strict protocols for collecting, using, and protecting student personal information. Key provisions include requiring agencies to obtain informed consent before collecting student data, developing privacy policies, maintaining secure information systems, and prohibiting the use of student information for targeted advertising. The Department of Education will be responsible for creating a registration process, developing a model memorandum of understanding between agencies and school boards, and establishing a grant program to help smaller agencies improve their data security. The bill also introduces an annual audit process to ensure compliance, with potential fines of up to $10,000 for first-time violations and $50,000 for subsequent violations. Agencies found to be in substantial violation may be removed from the registry and prohibited from providing services. The legislation aims to balance the beneficial work of student support agencies with robust protections for students' personal information, implementing a phased approach to implementation with full compliance expected by the 2028-2029 school year.
