This bill requires "covered providers," which are entities that create or produce generative artificial intelligence (AI) systems with over one million monthly users that are publicly accessible in Washington state for personal use, to embed "provenance data" into any video, image, audio, or combination thereof that is created or "materially altered" by their AI systems. Provenance data is information embedded in digital content to verify its authenticity or modification history, and it must be made difficult to remove or tamper with, with compliance considered met by using common standards like watermarking or metadata. "Materially altered" refers to significant changes that alter the content's data substantially, excluding minor edits like brightness adjustments or cropping. The bill also mandates that government agencies clearly and conspicuously disclose to consumers when they are interacting with an AI system, using plain language and avoiding deceptive practices, and this disclosure is required regardless of whether it would be obvious to the consumer. Importantly, the bill exempts business-to-business uses, sales, licensing, or distribution of AI systems, as well as content exclusively for video games or interactive experiences, and systems used solely for upscaling, noise reduction, or compression. Waivers of these provisions are void, and the Attorney General can bring actions to enforce the chapter under the Consumer Protection Act.
