This bill allows municipalities in New Hampshire to designate portions of state and local highways for All-Terrain Vehicle (ATV) use, with several important conditions and regulations. Municipalities can choose specific highway sections for ATV travel, but cannot restrict other vehicles' existing legal use. ATVs on these designated highway portions must operate at a maximum speed of 40 miles per hour, and drivers must hold a valid driver's license. ATVs will be subject to the same traffic enforcement laws as other motor vehicles, with additional equipment requirements including directional signals, emergency flashers, and a horn. The Department of Transportation will design special signage for these ATV-allowed highway sections, with municipalities responsible for sign installation and maintenance costs. Several state departments, including Safety, Transportation, Fish and Game, and Natural and Cultural Resources, will develop rules to ensure motorist safety and facilitate ATV transportation. The bill will take effect on January 1, 2026, providing municipalities with a new option for expanding ATV transportation infrastructure.
