Bill Summary

Land development; solar canopies in parking areas. Provides that any locality may include in its land development ordinances a provision that requires that an applicant must install a solar canopy over designated surface parking areas. Such provisions shall apply only to nonresidential parking areas with 100 parking spaces or more and may require coverage of up to 50 percent of the surface parking area. The bill provides that localities shall allow for deviations, in whole or in part, from the requirements of the ordinance when its strict application would prevent the development of uses and densities otherwise allowed by the locality's zoning or development ordinance. The bill has a delayed effective date of July 1, 2026.

AI Summary

This bill allows local governments in Virginia to create land development ordinances that require solar canopies in large nonresidential parking lots. Specifically, these ordinances can mandate solar canopies over surface parking areas with 100 or more spaces, potentially covering up to 50 percent of the parking area. A "solar canopy" is defined as a raised structure containing solar photovoltaic panels. The bill provides flexibility by requiring localities to allow deviations from the solar canopy requirement if strict compliance would prevent other permitted land uses or densities. Additionally, developers would be permitted to use the electricity generated by these solar canopies for their own consumption and can choose how to interconnect the solar system with the electrical grid according to existing Virginia Administrative Code regulations. The provisions of this bill will become effective on July 1, 2026, giving local governments and developers time to prepare for the new requirements.
