This concurrent resolution requests the Department of Environmental Quality (DEQ) to conduct a comprehensive study on reforming the Commonwealth's litter tax, which has not been significantly updated since its inception despite a 744 percent increase in plastic production. The study will require a detailed analysis of Virginia's solid waste and recycling streams, examining current disposal methods, recycling infrastructure, economic opportunities, and market conditions. Specifically, the DEQ must investigate recycling materials, processing methods, revenue and cost structures, recycling infrastructure capacity, and opportunities for increasing recycling across the state. The resolution also mandates an examination of economic opportunities in the recycling system, including potential job creation, business opportunities, and barriers to recycling. Additionally, the study will explore developing a cigarette litter abatement fee and potential litter tax exemptions for small businesses. The DEQ is required to use an independent facilitator, include representatives from relevant advisory boards, and ensure transparent decision-making with recorded votes. The department must complete its study by November 30th in two consecutive years, submitting executive summaries and reports to the Governor and General Assembly, with technical assistance provided by the Departments of Taxation and Planning and Budget.
