AI Summary

This bill establishes comprehensive regulations for the development, deployment, and use of high-risk artificial intelligence (AI) systems by public bodies in Virginia. The legislation defines high-risk AI systems as those intended to autonomously or substantially make consequential decisions that significantly impact individuals, such as those affecting employment, education, financial services, healthcare, housing, and other critical areas. The bill requires developers of high-risk AI systems to provide detailed documentation about system limitations, potential algorithmic discrimination risks, and performance evaluations. Deployers must complete impact assessments before implementing such systems, notify consumers when AI is used to make consequential decisions, and provide opportunities for explanation and appeal of adverse decisions. The Chief Information Officer (CIO) of the Commonwealth is mandated to develop policies and procedures for high-risk AI systems, including guidelines for procurement, implementation, and ongoing assessment. The bill aims to mitigate algorithmic discrimination by requiring transparency, risk management, and continuous monitoring of AI technologies. A notable provision is the delayed effective date of July 1, 2027, which allows public bodies time to prepare for compliance. Additionally, the bill requires the CIO to convene a work group to examine the impact of these requirements on local governments and submit a report by December 1, 2025, ensuring a collaborative approach to implementing these comprehensive AI governance standards.
