This bill amends Kentucky law (KRS 17.545) regarding restrictions on sex offenders (registrants) living near schools and childcare facilities. The bill introduces a two-tiered approach to residency restrictions: for registrants who became sex offenders before the bill's effective date, they are prohibited from living within 1,000 feet of schools, playgrounds, or daycare facilities; for registrants who become sex offenders after the bill's effective date, the restriction is expanded to 3,000 feet. The distance is measured in a straight line from the property line of the registrant's residence to the property line of the school, playground, or daycare facility. Violating these residency restrictions is classified as a Class A misdemeanor for the first offense and a Class D felony for subsequent offenses. The bill also maintains existing provisions that prohibit registrants from loitering, working, or operating mobile businesses near these types of facilities without prior written permission. Additionally, the law continues to restrict registrants over 18 who have committed crimes against minors from living in the same residence as a minor, with some exceptions for family relationships. These provisions aim to enhance public safety by limiting sex offenders' proximity to areas where children are frequently present.
