Bill Summary

Create a new section of KRS Chapter 532 to provide that any person who has been convicted of, pled guilty to, or entered an Alford plea to a sex crime in which the victim was under the age of 12 shall undergo medroxyprogesterone acetate treatment; provide that treatment shall begin no later than one month before the person is released from custody; provide that treatment shall continue until the person is released from probation, parole, or postincarceration supervision; provide that the person shall be evaluated by a licensed physician prior to treatment to determine if the person is an appropriate candidate for treatment; provide that the Department of Corrections shall administer the treatment; authorize the Department of Corrections to promulgate administrative regulations to implement the requirements.

AI Summary

This bill requires individuals convicted of sex crimes involving victims under 12 years old to undergo medroxyprogesterone acetate (a chemical treatment that reduces sexual urges) as an additional penalty. The treatment must begin one month before the offender's release from custody and continue until they are released from probation, parole, or post-incarceration supervision. Before receiving the treatment, the offender must be evaluated by a licensed physician to determine if they are a suitable candidate and must be informed about potential side effects. The offender is responsible for treatment costs, unless they are determined to be indigent, in which case the Commonwealth will cover expenses. If an offender intentionally fails to comply with the treatment requirements, they may be reincarcerated for the remainder of their initial sentence or post-incarceration supervision period. The Department of Corrections will be responsible for administering the treatment and developing administrative regulations to implement these requirements. The court must specifically designate in its judgment whether the victim was under 12 years old at the time of the offense.
