This bill amends the election law to allow a candidate for office to remain employed by a board of elections under specific conditions. Currently, board of elections employees are prohibited from being candidates in elections overseen by their board. The new provisions permit such employment with prior authorization by a majority vote of the elections commissioners. The state board must establish rules and regulations governing these circumstances, including restrictions that prevent the employee from working directly on the election in which they are a candidate. An employee is considered a candidate upon filing a nominating petition or accepting a nomination, and may remain in "leave without pay" status until the election is over. If there are no primary elections for the office sought, the candidate may remain on the payroll for up to 90 days before a general election. The bill does not apply to unpaid party positions, maintaining a balance between allowing political participation and preventing potential conflicts of interest in election administration.
