This bill amends Kentucky Revised Statutes (KRS) 531.335 to expand the existing law on possession or viewing of sexually explicit material involving minors. The bill broadens the definition to include computer-generated images of minors, in addition to actual minors, making it a criminal offense to knowingly possess or intentionally view such material. The law specifies that accidental or inadvertent viewing is not prohibited, and exceptions exist for law enforcement investigations, legal proceedings, and certain viewing by parents, guardians, or school administrators. The bill establishes criminal penalties based on the age of the minor depicted: a Class D felony if the minor is under 18, and a Class C felony if the minor is under 12. Importantly, the bill introduces a new provision requiring that individuals convicted under this statute must serve at least 85% of their sentenced term before being eligible for probation or parole, which significantly reduces the possibility of early release for offenders of this crime.
