This bill establishes a new Behavioral Health Fund to provide grants to public schools for improving individualized education programs (IEPs) with behavioral intervention plans. The fund will be administered by the Indiana Department of Education in coordination with the Behavioral Health Commission, and will be financed through state appropriations, grants, and donations. The bill defines an "aggressive student" as a student with a documented history of frequent disruptions to the learning environment despite the school's attempts to modify their behavior. It creates a detailed application process for schools to receive grants, with priorities given to achieving geographic balance across urban, suburban, and rural school corporations and addressing documented funding needs for behavioral intervention plans. The bill also introduces a new procedure for handling aggressive students who are removed from a classroom, requiring principals to develop a classroom reintegration plan that may include returning the student to their original class, placing them in another appropriate class or in-school suspension, and mandating a meeting with the student, teacher, and parents to determine an appropriate behavior plan. Starting in 2026, the department must submit an annual report about the fund to the legislative council. The fund's money will not revert to the general fund at year's end and will be continuously appropriated for the program's purposes.
