AN ACT to amend the education law, in relation to providing water safety instruction in schools

This bill requires public school districts in New York to provide water safety instruction for students from kindergarten through twelfth grade. Schools must send home asynchronous water safety materials annually and can offer instruction designed to educate students about water safety. The instruction, which will be defined by the Commissioner of Education in consultation with the Department of Health, must be age-appropriate and cover topics such as proper use of flotation devices, water condition awareness, rip current response, safe swimming behaviors, pool barriers, importance of swim lessons, avoiding alcohol during water recreation, cardiopulmonary resuscitation (CPR) for drowning victims, and proper first aid procedures. While schools are encouraged to provide this instruction, participation is voluntary, and each district must notify the commissioner if they choose to offer the program. The commissioner is authorized to provide technical assistance in developing curricula that is tailored to students' needs and abilities at different grade levels, with the goal of building awareness, skills, self-confidence, and support in understanding and practicing water safety. The bill will take effect on the first of July following its passage.
