Bill Summary

Child labor; child engaged in the work of content creation; trust account. Requires that a child under the age of 16 who meets certain criteria specified in the bill to be considered a child engaged in the work of content creation be compensated by the content creator, defined in the bill, whose video content includes such child's likeness, name, or photograph. The bill requires the content creator to set aside gross earnings on the video content that includes the likeness, name, or photograph of the child in a trust account to be preserved for the benefit of the child upon attaining 18 years of age or having been declared emancipated. The bill also requires the content creator to maintain certain records specified in the bill and provide them to the child and the holder of the trust account on an ongoing basis. The bill also allows the child, or his parent or guardian on behalf of such child, to commence a civil action if the content creator fails to maintain the required records and to enforce the provisions of law related to the trust account. This bill is identical to SB 998.

AI Summary

This bill addresses child labor protections specifically for children under 16 who are featured in online content creation. The legislation requires content creators who regularly feature children in their videos (defined as having a child appear in at least 30% of compensated video content within a 30-day period) to establish a trust account for the child. This trust account must set aside a proportional percentage of gross earnings from videos featuring the child, which will be preserved until the child turns 18 or becomes emancipated. Content creators must maintain detailed records about the child's participation, including their name, age, video view counts, total video content minutes, and compensation generated. The bill allows the child, or their parent/guardian, to take civil action if the content creator fails to maintain these records or establish the required trust account. The legislation also includes provisions ensuring the child's safety, such as requiring adult supervision and prohibiting exposure to hazardous conditions. Importantly, the bill defines key terms like "content," "content creator," and "online platform" to provide clear guidelines for implementation, and it specifically excludes children creating their own content from these regulations.
