Bill Summary

AN ACT to amend the penal law, in relation to individuals engaged in prostitution who are victims of or witnesses to a crime

AI Summary

This bill provides legal immunity from prosecution for individuals engaged in prostitution (sections 230.00 and 230.03 of the penal law) who are victims or witnesses to a crime, under specific circumstances. The bill allows such individuals to report a crime to law enforcement, seek medical care, or assist in an investigation without fear of being charged for prostitution-related offenses that occurred at or near the time of the crime. To qualify for immunity, the person must act in good faith and not during or after an arrest or investigation. The bill also establishes a legal process where an erroneously charged victim or witness can request a hearing within 15 days of being charged, during which the court can consider all legally permissible evidence. If the court determines by clear and convincing evidence that the conditions for immunity were met, the charges will be dismissed; otherwise, the charges will remain. The bill defines "crime" broadly to include acts that reasonably appear to be criminal, regardless of whether they ultimately result in a criminal conviction. The law will take effect 60 days after becoming law and will apply to prosecutions pending at that time.
