This bill amends the Community-Integrated Living Arrangements Licensure and Certification Act by significantly changing the Department of Human Services' inspection and monitoring procedures for community mental health and developmental services agencies. Previously, the Department could conduct site visits and inspect records and premises at its discretion. Now, the bill requires the Department to establish a mandatory system of regular, unannounced on-site inspections that must occur at least annually for each licensed agency and its certified programs. These annual inspections, to be conducted by the Department's central office, have specific goals including determining compliance with policies and procedures, evaluating adherence to federal standards, reviewing complaints from advocates, following up on human rights findings, identifying administrative problems, and preventing abuse and neglect. The bill removes the Department's previous discretionary site visit language and replaces it with a more structured, comprehensive annual inspection mandate designed to ensure higher quality oversight and protection of individuals in community-integrated living arrangements.
