This bill amends the Pennsylvania Construction Code Act by adding a new chapter that establishes a comprehensive process for evaluating the potential impact of proposed construction on endangered and threatened species. Under the new regulations, applicants seeking a building permit must submit detailed information about their proposed construction to three state agencies: the Pennsylvania Fish and Boat Commission, the Pennsylvania Game Commission, and the Department of Conservation and Natural Resources. These agencies will have 90 days to review the information, conduct site visits if necessary, and determine whether the proposed construction would negatively affect endangered or threatened species. If a negative effect is identified, the municipality cannot issue a building permit until the applicant takes steps to mitigate or eliminate the potential harm. The bill provides an appeals process for applicants and allows the agencies to charge reasonable fees to cover review costs. Additionally, the bill appropriates $20 million to help these agencies recruit and train staff to administer the new requirements. Importantly, the new regulations do not apply to minor residential building additions, alterations, or repairs. The bill will take effect immediately for appropriation purposes, with the remainder of the regulations going into effect 180 days after passage.
