This bill aims to protect students with disabilities who have an Individualized Education Program (IEP) or receive accommodations under Section 504 of the Rehabilitation Act of 1973 from being required to take multiple Regents examinations on the same day. Currently, students with extended testing time provisions may end up taking exams for 10 or 11 consecutive hours when two Regents exams are scheduled on the same date. The legislature recognizes the Department of Education's concerns about exam security but believes that giving these students a break between exams is more beneficial than strictly adhering to the original testing schedule. The bill directs the Commissioner of Education to create regulations that ensure students with disabilities who have extended testing time provisions can take only one Regents examination per day. This change is intended to reduce the testing burden and potential stress on students with disabilities, while still maintaining the integrity of the examination process. The bill will take effect 180 days after becoming law, with immediate authorization for developing necessary implementation regulations.
