This bill introduces the "Patient Privacy Protection Act," which amends the civil practice law and rules to prohibit ex-parte interviews (one-sided conversations or interviews without the other party present) of treating physicians or healthcare providers in specific types of legal actions, including personal injury, medical malpractice, dental malpractice, podiatric malpractice, and wrongful death cases. The bill specifically prevents parties or anyone acting on their behalf from directly or indirectly conducting these unilateral interviews with another party's healthcare providers. However, the bill does allow exceptions for attorneys or their agents who represent the patient, the patient's estate, or the patient's guardian to have ex-parte conversations with the patient's own treating physicians or healthcare providers. The act will take effect thirty days after becoming law and will apply to all relevant legal actions filed on or after that date, as well as to pending cases, with the caveat that it will not retroactively penalize conduct that occurred before the law's effective date.
