This bill, amending the civil service law, allows certain public employees in New York, including those working for the state, counties, public authorities, school districts, and participating employers in retirement systems, to use their accrued time, such as sick time, compensation time, personal time, or vacation time, during mandatory waiting periods for workers' compensation claims or when indemnity benefits are not being received due to a controverted claim. Importantly, employers cannot force employees to use this accrued time during these periods, and if it's later determined that no waiting period was required or benefits should have been paid, employees are entitled to have their used time fully restored. This provision does not apply to employees already covered by a collective bargaining agreement, but employee organizations can choose to opt in to these protections, negotiate for different benefits, or opt out if mutually agreed upon. The bill also clarifies that it does not diminish any rights or benefits established through collective bargaining.
