This bill amends the New York Public Health Law to increase monetary penalties for violations of public health regulations. Specifically, the bill raises the standard civil penalty for violations from $2,000 to $3,000 per violation. For violations committed by nursing home, hospital, or residential care operators, the maximum penalty is increased to $5,000 per violation. The bill also introduces escalating penalties for repeat or serious violations: subsequent violations within 12 months that pose a serious health and safety threat can now result in penalties up to $10,000, and violations directly causing serious physical harm can incur penalties up to $20,000. Additionally, the bill provides that penalty amounts collected from nursing home operators in excess of $10,000 may be transferred to a nursing home quality improvement demonstration program to support projects designed to enhance care quality.
