This bill modifies the existing Vehicle and Traffic Law regarding penalties for passing a stopped school bus. Currently, the law imposes increasing fines and potential imprisonment for first, second, and subsequent violations within a three-year period. The new provision adds a requirement that for any second or subsequent violation, the offender may be required to attend a mandatory driver education course if recommended by the court. The course is intended to educate drivers about the dangers of illegally passing a stopped school bus, which can put children at serious risk when they are entering or exiting the vehicle. The fine structure remains unchanged: first conviction carries a fine of $250-$400, second conviction within three years has a fine of $600-$750, and third or subsequent violations within three years result in a fine of $750-$1,500. Each offense can also potentially include imprisonment. The bill will take effect 90 days after becoming law, with immediate authorization for preparing necessary implementation regulations.
