This bill enacts the New York Healthy Vending Act, which establishes comprehensive nutrition standards for food and beverage vending machines located on state-owned or leased property. The law requires that vending machines offer a progressively increasing percentage of healthy food and beverage options, starting with 25% within the first year, rising to 50% within two years, and reaching 75% within three years. Healthy options must meet specific nutritional criteria, including limits on calories, sodium, fat, and sugar content. Snack foods must have zero trans fat and no more than 200 milligrams of sodium per package, while entree items must meet additional nutritional standards, such as containing fruits, vegetables, whole grains, or essential nutrients. Healthy beverage options include fat-free milk, low-fat dairy milk, fortified soy milk, and 100% fruit or vegetable juices with no added sweeteners. The bill mandates that healthy options be prominently displayed and positioned for maximum visibility and sales potential. Vending machine operators must also disclose calorie information and can be subject to civil fines for non-compliance, ranging from $100 for a first violation to $1,000 for multiple violations within a six-month period. The Department of Health will be responsible for enforcing the law, conducting periodic reviews of nutrition standards, and reporting on implementation progress.
