This bill adopts the Sexual Assault Emergency Care Act, which establishes comprehensive requirements for hospitals when providing care to sexual assault survivors. The act requires hospitals to provide medically accurate written and oral information about emergency contraception to sexual assault survivors in a language they understand, and to offer a complete course of emergency contraception unless declined by the survivor. Hospitals must also train their personnel on providing accurate information about emergency contraception and develop policies to ensure compliance, even if individual healthcare providers have moral or religious objections. The bill defines key terms such as sexual assault, emergency contraception, and medically accurate information, and establishes a complaint and enforcement mechanism through the Department of Health and Human Services. For first-time violations, hospitals will receive a written warning and be required to correct deficiencies, while subsequent violations can result in fines of $1,000 per sexual assault survivor who was not properly informed or offered emergency contraception, or $1,000 per month until required training is completed. The department is also required to submit biennial reports to the legislature detailing complaints and actions taken, while maintaining the confidentiality of complainants.
