This Joint Resolution Constitutional Amendment proposes to add a new section to the Illinois Constitution that would require parental notification before an abortion can be performed on a minor (someone under 18 and not married or emancipated) or a person under legal disability (an adult deemed by a court to be unable to manage their affairs due to mental illness or developmental disability). Specifically, the amendment mandates that at least 48 hours of direct notice, either in person or by phone, must be given to an adult family member or legal guardian of the pregnant individual, or a written statement from a referring physician confirming they have provided such notice, unless certain exceptions apply. These exceptions include the individual being accompanied by the adult entitled to notice, the adult waiving notice in writing, a medical emergency certified by the physician, or if the minor declares in writing they are a victim of sexual abuse, neglect, or physical abuse by the adult who would otherwise receive notice.
