This bill modifies provisions related to the New York Power Authority's (NYPA) use of St. Lawrence county economic development power and its authority-TMED contract. Specifically, the bill removes a previous provision that would have reduced the amount of economic development power NYPA could use to generate net earnings from 20 megawatts to 10 megawatts after five years. Instead, the bill allows NYPA to use up to 20 megawatts of St. Lawrence county economic development power to generate net earnings, with the limit being the lesser of 20 megawatts or the amount of power not yet allocated under the authority-TMED contract. The bill also updates the definition of the authority-TMED contract to include any extensions or successor contracts that expire on or before 2040, referring to a specific agreement between NYPA and the Town of Massena Electric Department for selling power for economic development purposes. At least 15% of the net earnings from this fund must be dedicated to energy-related projects, and the fund can also cover NYPA's administrative costs related to the northern New York power proceeds allocation program.
