The legislation requires specific entities (such as the governor, university boards, local school boards, and county commissions) to determine whether an event qualifies as sexually explicit upon request, with a 30-day timeline for making such determinations. If an entity determines that an event is sexually explicit, the recipient must repay all expended state or federal funds within 20 business days. The bill provides an appeals process allowing requestors 15 calendar days to challenge a determination, which would be handled as a contested case hearing under Wyoming's Administrative Procedure Act. Notably, this prohibition applies to all branches of government, including executive, legislative, and judicial agencies, as well as educational institutions, cities, towns, counties, and political subdivisions. The law is set to take effect on July 1, 2025, giving entities time to prepare for its implementation.
