This bill amends the New York State Penal Law to expand the definition of first-degree assault to include intentionally exposing first responders or correction officers to fentanyl or fentanyl-related substances. Specifically, the bill adds a fifth provision to the assault in the first degree statute, making it a class B felony to deliberately expose a first responder (as defined in the public health law) or a correction officer to fentanyl, fentanyl derivatives, or opiates containing these substances through any means, such as throwing, tossing, or injecting these substances. The bill aims to provide additional legal protection for first responders and correction officers who may be at risk of accidental exposure to dangerous and potentially life-threatening drugs during the course of their duties. The law will take effect on the first of November following its passage and will apply to offenses committed on or after that date, allowing for necessary regulatory preparations to be made in advance of the implementation.
