AI Summary
This bill, known as the "Marvin Mayfield Act", is comprehensive legislation aimed at eliminating mandatory minimum sentences and reforming the state's sentencing framework. The bill makes several key changes to the penal law and criminal procedure law, fundamentally shifting the approach to sentencing. It gives judges more discretion in determining appropriate sentences by removing mandatory minimum terms and allowing courts to impose definite sentences of less than one year or alternative forms of punishment like probation. The bill modifies sentencing guidelines for various felony classes, removes several provisions related to mandatory sentencing for specific offenses, and emphasizes rehabilitative goals over punitive measures. Key modifications include allowing courts to fix sentences based on individualized circumstances, reducing mandatory minimum terms, expanding alternatives to imprisonment, and requiring courts to provide written explanations for sentencing decisions. The legislation also removes provisions related to mandatory sentencing for drug offenses, violent felonies, and other specific crime categories, with the overarching goal of creating a more flexible and individualized approach to criminal sentencing that prioritizes rehabilitation and proportional punishment.
