This bill introduces a new chapter in Indiana law that prohibits the advertising of marijuana products and marijuana businesses within the state's borders. The bill defines "marijuana" according to existing state law and broadly defines "person" to include individuals, businesses, and various legal entities. It allows exceptions for advertisements under contracts entered into before July 1, 2025, and for low THC hemp extract advertisements. The attorney general is empowered to take legal action against violators, with escalating civil penalties: $10,000 for a first violation, $15,000 for a second violation, and $20,000 for subsequent violations. The attorney general can also seek injunctions to prevent future violations and recover investigation and legal costs. All collected civil penalties will be deposited in the state's general fund.
