This bill establishes a new process for recalling locally elected officials in Tennessee, allowing voters to remove certain elected local government and school board members from office through a petition and election process. The bill defines "local officials" as elected members of legislative bodies, mayors, sheriffs, trustees, registers, clerks, property assessors, and school board members. To initiate a recall, a petition must be signed by registered voters equal to at least 66% of the total votes cast for the official in their last regular election, and must include a statement of the grounds for removal. The county election commission will verify petition signatures and, if sufficient, call a recall election where voters can choose to vote "for recall" or "against recall". If 66% or more of voters support the recall, the official will be removed from office and the position declared vacant. Local governments must opt into this recall process by a two-thirds vote of their legislative body, and the recall election cannot be held within 90 days before or after a regular election. The bill also removes an existing section of Tennessee Code related to education and takes effect immediately upon becoming law.
