This bill adopts the Residential Tenant Clean Slate Act, which provides a mechanism for sealing eviction records in certain circumstances. The act defines key terms like "clean slate relief" (sealing of records), "eviction proceeding" (legal actions involving residential tenancy), and establishes procedures for tenants to have their eviction records sealed. Tenants can petition for clean slate relief immediately if an eviction case is dismissed, or after three years have passed since a judgment against them. The bill allows tenants to seek relief for various scenarios, including COVID-19 pandemic-related evictions, cases involving minor children, or proceedings that violated existing tenant protection laws. When clean slate relief is granted, court records related to the eviction are sealed, and tenants can legally state that the eviction never occurred when applying for housing, employment, education, or other opportunities. Landlords are prohibited from considering sealed eviction records in housing applications. The act will become operative on January 1, 2026, and applies to all eviction proceedings, regardless of when they occurred. The State Court Administrator is authorized to create rules for implementing the act.
