AI Summary
This bill establishes a process for suspending retirement benefits for members of the Public Employees' Retirement System (PERS) and the Supplemental Legislative Retirement Plan (SLRP) who are convicted of felonies involving the misuse or misappropriation of public funds. Specifically, if a member is convicted of a felony involving public funds on or after July 1, 2025, a court will conduct a hearing to determine if the member's retirement benefits should be suspended. The suspension will not take effect until all appeals of the conviction have been concluded. Once the suspension is in place, the member will not receive any retirement benefits until they have made full restitution of the misappropriated public funds, as determined by the Attorney General. The bill applies to both active and retired members, and if a member is part of multiple retirement systems, the suspension will only apply to the system related to the specific felony. The bill also includes provisions to protect the retirement system from liability for mistaken payments and emphasizes that any ambiguity should be resolved in favor of the member. The suspension applies to both state and federal convictions that would be considered felonies under Mississippi law.
