This bill amends the New York Penal Law to expand the definition of arson in the first degree to include situations where a person is manufacturing, attempting to manufacture, or endeavoring to manufacture a controlled substance, and in the process destroys or causes the burning of a building or its contents that is inhabited or occupied by one or more persons. The bill also adds provisions that make it arson in the first degree if such manufacturing activities cause a person to be burned. The term "controlled substance" is defined by referencing article two hundred twenty of the penal law, and an "incendiary device" is defined as a breakable container designed to explode or produce uncontained combustion upon impact, containing flammable liquid with a wick or similar ignition device. By explicitly including fires caused during the manufacture of illegal drugs within the arson statute, the bill aims to create stronger legal consequences for individuals whose illegal drug manufacturing activities result in property destruction or personal injury. The act will take effect 60 days after becoming law.
