Currently, the law already prohibits an incarcerated person from causing or attempting to cause an employee to come into contact with blood, seminal fluid, urine, feces, or toilet bowl contents with the intent to harass, annoy, threaten, or alarm them. The bill adds saliva to this list of bodily fluids, making such an act a specific criminal offense. The bill also updates the language to use gender-neutral terms like "incarcerated individual" or "respondent" instead of "he or she." The amendment will take effect 60 days after it becomes law, providing a clear legal mechanism to prosecute incidents involving the intentional expulsion of saliva toward correctional facility employees.
