This bill modifies Virginia law to protect amateur radio operators' rights within common interest communities, property owners' associations, condominiums, and cooperative housing developments by preventing these associations from prohibiting amateur radio antenna installations after July 1, 2025. The bill allows lot, unit, or proprietary lessee owners to install amateur radio antennas on their owned property or roof, subject to reasonable restrictions established by the association. These restrictions include requiring detailed installation plans from a licensed contractor, compliance with building codes and safety standards, maintaining the antenna in a safe condition, paying installation and maintenance costs, visually screening ground-mounted equipment if visible from the street or neighboring properties, and agreeing to remove and restore the area if the antenna is no longer needed or the property is sold. Associations can still prohibit antenna installations if they are not technically feasible or pose safety risks due to structural or engineering conditions. The bill aims to balance the rights of amateur radio enthusiasts with the aesthetic and safety concerns of community associations by providing clear guidelines for antenna installation and maintenance.
