This bill requires certain health care providers (licensees) who have been found to have committed professional misconduct or have been found guilty of specific offenses to disclose detailed information about their disciplinary status to current and new patients before providing medical treatment. The disclosure must include the provider's status with the Office of Professional Medical Conduct, the length and expiration of penalties, causes for disciplinary action, practice restrictions, and contact information for the medical conduct office. The bill specifically mandates disclosure for serious offenses such as sexual misconduct, drug or alcohol abuse that impairs patient care, criminal convictions involving patient harm, and inappropriate prescribing. Providers must obtain a signed acknowledgment from patients or their health care representatives before treatment, with exceptions for medical emergencies. If a patient cancels an appointment after receiving the disclosure, they will not be charged. Providers who fail to comply can be subject to penalties, and the commissioner is required to develop regulations to implement these requirements. The bill will take effect on January 1, 2026, and apply to probationary orders issued on or after that date, aiming to increase transparency and patient safety by ensuring individuals are aware of their health care provider's disciplinary history.
