Bill Summary
AN ACT to amend the general business law, in relation to the restriction of certain substances in menstrual products
AI Summary
This bill establishes new regulations for menstrual products sold in New York State by defining and restricting certain harmful chemical substances. The bill defines "menstrual products" as items used to catch menstruation and vaginal discharge, such as tampons, pads, and menstrual cups. It introduces the concept of "restricted substances," which include a specific list of chemicals deemed unsafe, such as lead, mercury, formaldehyde, toluene, and various phthalates. The legislation prohibits the intentional addition of these restricted substances to menstrual products at any level, with a two-year period to establish specific threshold levels for unintentional traces of these substances. The Department of Health, in consultation with the Department of Environmental Conservation, will establish and periodically review these threshold levels, which must be set at the lowest feasible level. Manufacturers must comply with these restrictions for all menstrual products distributed, sold, or offered for sale in New York State, whether for retail, wholesale, professional, commercial, or promotional purposes. The bill will take effect twelve months after becoming law, with preliminary regulatory work authorized to begin immediately.
