This bill requires the North Dakota Department of Emergency Services to conduct a comprehensive foreign adversary threat assessment and produce a detailed report by July 1, 2026. The department must identify vulnerable sectors such as critical infrastructure, technology, agriculture, energy, and academia, and assess foreign adversarial influence beyond land acquisition, including strategic investments, partnerships, and various forms of economic, educational, and political influence. The report must evaluate existing investments for legal compliance, identify undermonitored sectors, and propose mitigation strategies to manage foreign adversarial risks while supporting economic growth and security. Specifically, the report will provide a detailed analysis of threats specific to North Dakota, identify critical risks across sectors, offer sector-specific mitigation recommendations, and include a proposal for establishing a state intelligence unit with structures and procedures for continuous monitoring of foreign adversary threats. By September 1, 2026, the department must present its findings and recommendations, including any proposed legislation, to the legislative management, with the report remaining confidential and exempt from public disclosure.
