This bill amends the Real Property Actions and Proceedings Law to add new conditions for landlords seeking to evict tenants for non-payment of rent. Specifically, the bill requires that at the time of filing an eviction proceeding, there must be no violations of state, city, or local housing maintenance codes in the subject apartment or building's common areas. Landlords must also ensure there are no dangerous living conditions such as lack of heat, running water, electricity, adequate sewage disposal, rodent infestations, or other health and safety hazards that have existed for five or more days. If such violations or hazardous conditions exist, the landlord can only proceed with an eviction by filing an affidavit explaining that the violations were recorded erroneously or that a government agency failed to remove them. The court can reject the eviction proceeding if it finds the affidavit's claims are untrue or if violations or hazardous conditions are present. Additionally, the bill requires that the 14-day notice for eviction include information about good cause eviction laws, reasons for lease non-renewal, and rent increase justifications. The changes aim to provide tenants with additional protections against eviction when housing conditions are substandard.
