This bill removes end-stage renal disease (ESRD) facilities from the Mississippi Health Care Certificate of Need (CON) law. Specifically, the bill eliminates the existing statutory definition of "end-stage renal disease facilities" from Section 41-7-173, which previously defined ESRD facilities as kidney disease treatment centers, including freestanding hemodialysis units and limited care facilities. The Certificate of Need law requires healthcare providers to obtain approval from the State Department of Health before making certain capital expenditures or offering new health services. By removing ESRD facilities from the definition of healthcare facilities subject to this law, the bill will make it easier for these facilities to expand or establish new locations without going through the CON review process. The bill is set to take effect on July 1, 2025, giving healthcare providers and state agencies time to prepare for the change in regulatory requirements.
