AI Summary

This bill requires residents who are 60 years or older in certain long-term care facilities (including nursing facilities, assisted living facilities, personal care homes, and adult foster care facilities) to obtain a "preneed contract" within six months of admission. A preneed contract is a pre-arranged funeral or burial service agreement that specifies services and merchandise for final disposition of a person's body after death. If a resident does not obtain such a contract within the specified timeframe, the facility must purchase one on their behalf and add the cost to the resident's regular charges. For residents already in these facilities as of July 1, 2025, who do not have a preneed contract, they must obtain one by December 31, 2025, or the facility will purchase one for them. Importantly, the bill explicitly prohibits facilities from refusing admission or taking any adverse action against residents based on whether they have a preneed contract. The State Department of Health will be responsible for enforcing these provisions, and the law will take effect on July 1, 2025.
