This bill modifies Indiana's E-Verify requirements for public works projects, focusing on employment verification for contractors and subcontractors. E-Verify is a federal electronic system that allows employers to confirm the eligibility of employees to work in the United States. The bill requires construction managers (CMc) and subcontractors to submit E-Verify case verification numbers for each individual before they begin work on a public works project. Starting July 1, 2025, contractors will be prohibited from employing individuals who receive a final nonconfirmation status through E-Verify. Public agencies are now mandated to only enter into or renew contracts with contractors who meet specific conditions, including: enrolling in E-Verify, verifying the work eligibility of employees hired after June 30, 2011, providing documentation of E-Verify enrollment, and submitting E-Verify case verification numbers. Additionally, contractors must sign an affidavit affirming they do not knowingly employ unauthorized aliens and that their E-Verify documentation is complete and accurate. This legislation aims to strengthen employment verification processes and prevent the hiring of unauthorized workers on public works projects.
