This bill modifies existing juvenile justice laws to require the Director of the Department of Juvenile Justice to inquire about the immigration status of juveniles or adults committed to a secure facility after being adjudicated delinquent or convicted of a violent juvenile felony. If the individual was born outside the United States and is not a U.S. citizen, or if their citizenship status is unknown, the facility director must query U.S. Immigration and Customs Enforcement (ICE) to determine their legal status. If the query confirms the individual is in the United States illegally, the facility must communicate this information to ICE. The bill also adds provisions allowing the facility director to transfer custody of such individuals to ICE up to five days before their scheduled release, and enables the Governor to consent to transferring certain offenders to their home countries under existing treaties. Additionally, the bill expands existing confidentiality exceptions to allow for more information sharing about juveniles who have committed serious offenses or become fugitives, with the aim of improving public safety and immigration enforcement tracking for certain juvenile and adult offenders.
