This bill amends Indiana real estate law to require additional disclosures about radon when residential properties are being sold or transferred. Specifically, before signing a purchase agreement, a real estate broker representing a seller must ensure that the seller provides three key pieces of information to the buyer: (1) a warning statement from the Indiana Department of Health strongly recommending radon testing, which explains that radon is a Class A human carcinogen and the leading cause of lung cancer in nonsmokers; (2) a written disclosure of any known radon concentrations in the dwelling, including past test results, mitigation efforts, and details about any existing radon mitigation systems; and (3) a guide on radon testing and mitigation published by the Indiana Department of Health. These requirements apply to all types of residential real estate transfers, including sales, exchanges, leases with purchase options, and other transfers. The buyer must acknowledge receipt of these materials by signing a notification. The bill aims to increase awareness about the potential health risks of radon and ensure that homebuyers have comprehensive information about radon levels in a property before completing a purchase.
